Welcome to HabitMitra

These Terms of Service govern your access to and use of HabitMitra, including our website, web app, mobile app, account features, routine tracking, focus tracking, goal tracking, journaling, consistency insights, reminders, support features and related services.

HabitMitra is operated by Rohit Kumar Pani under the brand name "HabitMitra". By creating an account or using HabitMitra, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use HabitMitra.

1. About HabitMitra

HabitMitra is a personal productivity and daily-management platform that helps users manage routines, habits, focus sessions, goals, journaling, reminders and consistency.

HabitMitra is not a medical, therapy, mental health, financial, legal or emergency service. Any insights, reminders, streaks, suggestions or progress information shown inside HabitMitra are for personal organization and self-reflection only.

2. Account and User Responsibility

You may need to create an account to use certain HabitMitra features. You agree to provide accurate information and keep your login details secure.

You are responsible for all activity that happens through your account. If you believe your account has been accessed without permission, contact us immediately.

3. Your Personal Entries

You may add routines, habits, goals, focus records, journal entries, notes, reminders, missed reasons, preferences and other personal information inside HabitMitra.

You remain the owner of your personal entries. HabitMitra does not claim ownership over your routines, goals, journal entries or personal notes.

You give HabitMitra limited permission to store, process, display, sync, back up and analyze your information only for operating, personalizing, securing and improving the HabitMitra platform.

4. Acceptable Use

You agree not to misuse HabitMitra. You must not use HabitMitra for illegal or harmful purposes; attempt to hack, damage, overload or disrupt the platform; create fake accounts or impersonate another person; use bots, scraping tools or unauthorized automated access; upload malware or harmful code; misuse support, feedback or reporting features; or copy, reverse engineer or reproduce HabitMitra’s software, design, interface, content, branding or structure to create a competing product.

We may suspend or terminate your access if your activity violates these Terms or creates legal, security, payment or operational risk.

5. Subscriptions and Payments

Some HabitMitra features may be free, while some features may require payment or subscription.

Plan price, billing cycle, renewal terms and included features will be shown before payment. If a plan is auto-renewing, it will renew automatically unless you cancel it before the next billing cycle.

Payments may be processed through third-party payment providers such as Razorpay, UPI, card networks, banks, app stores or other authorized payment partners. Their own terms may also apply.

6. Cancellation and Refunds

Cancellation and refund rules are governed by our Refund & Cancellation Policy, where applicable.

Unless specifically stated otherwise, cancelling a subscription stops future renewal but does not automatically refund charges already paid.

7. Reminders and Notifications

HabitMitra may send reminders, push notifications, emails or alerts to support your routines, focus sessions, goals and other activities.

We do not guarantee that every reminder will be delivered on time or without interruption, as delivery may depend on your device, internet connection, notification settings, operating system, third-party services and other factors outside our control.

8. Platform Availability and Changes

We may update, improve, modify, add, remove or discontinue features from time to time.

We aim to keep HabitMitra stable and useful, but we do not guarantee that the platform will always be uninterrupted, error-free, secure or available at all times.

9. Intellectual Property

HabitMitra’s name, brand, logo, design, software, interface, workflows, content, graphics, icons and related materials are owned by us or licensed to us.

You are granted a limited, personal, non-transferable and revocable right to use HabitMitra for its intended purpose. You may not copy, sell, license, modify, distribute, reverse engineer or create a competing service using HabitMitra’s software, design, branding or platform materials without written permission.

The trademark application for HABIT MITRA has been filed in India. You must not use the HabitMitra name, logo or confusingly similar branding in a way that may mislead users or suggest an association with us.

10. Third-Party Services

HabitMitra may use third-party services for hosting, analytics, payments, email, notifications, authentication, crash reporting, support or security.

We are not responsible for failures, interruptions or actions of third-party services that are outside our control.

11. Privacy and Data Deletion

Your personal data is handled according to our Privacy Policy.

You may request account deletion, data deletion, correction or support by using the available in-app options or by contacting us at the email mentioned below. Some information may be retained where required for legal, tax, accounting, fraud prevention, security, dispute resolution or compliance purposes.

12. Limitation of Liability

To the maximum extent permitted by law, HabitMitra will not be liable for indirect, incidental, special, consequential or punitive losses, including loss of data, loss of profits, interruption of service, missed reminders, device issues, third-party service failures or losses caused by reliance on reminders, streaks, insights or platform suggestions.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Termination

You may stop using HabitMitra at any time.

We may suspend or terminate your access if you violate these Terms, misuse the platform, create security or legal risk, fail to complete payment where required, or if we discontinue the platform or any feature.

14. Changes to These Terms

We may update these Terms from time to time. When we update them, we will change the "Last updated" date.

For important changes, we may notify you through the platform, email or other reasonable means.

Continued use of HabitMitra after changes means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of India.

Subject to applicable consumer protection laws, disputes relating to HabitMitra shall be subject to the courts having jurisdiction in Odisha, India.
